This contract outlines an agreement and includes all contractual obligations made between Heidi Lang who will be referred to as the "service provider" and "the client".

The Client hereby engages the Service Provider to provide Makeup Applications on the date and time agreed, at the location determined by the Client. The Service Provider agrees to perform these Services for the Client and any other persons indicated by the Client in this Agreement ("Attendants"), who will also be included under the Terms and Conditions set forth in this Contract. This Agreement does not make the Service Provider an agent or employee of the Client for any purpose. The Service Provider shall at all times be considered as an Independent Service Provider.

The Client agrees to pay all rates and fees in accordance with the Payment section and in accordance with the current years service menu which is provided upon the initial inquiry with the Service Provider. When applicable, the Client is responsible for the Service Provider's travel fees & accommodation fees, in accordance with the Travel/Accommodation section. Regardless of any personal agreements made between the Client and any of their Attendants, the Client agrees to assume all responsibility for fees not paid by their Attendants to the Service Provider in accordance with the Payments section. The Client agrees to provide notice in advance of any and all allergies or conditions for themselves and for any Attendants receiving services in accordance with the Liabilities section. The Client shall provide the Service Provider with a safe and suitable work area at the location services are to be performed This location will also provide the Service Provider with the capability of performing their Services as described, by providing an appropriate area. Failure to provide for an adequate location may result in a less satisfactory result, for which the Service Provider shall not be held liable.

The Service Provider shall provide Services with due skill, time, diligence and care at the location, on the date and the Attendant's services. The Service Provider shall use their own products and tools for the services provided, unless otherwise agreed upon at the Client's request.

If the Service Provider is unable to perform agreed services for any unforeseeable reason or unavoidable situation beyond the Service Providers control, such as and not limited to, severe weather, fire, floods, family death, severe illness or an accident, the Service Provider agrees to make their best effort to source an equally qualified Makeup Artist complete the agreed upon Services for the same agreed upon terms of payment in accordance with this Agreement. The Service Provider is the sole director of the Services, and shall not be responsible for a less satisfactory result as the result of any interference in such direction by the Client or person present at the appointment.

A start and end time will be arranged and outlined through a schedule that is provided to the Client after the Service Provider receives event and service details outlined in this agreement. Please note that each service requires a certain minimum amount of time to be completed.

All persons named in this agreement for services need to be available at the scheduled times of said appointment, and failure to do so may result in breach of this agreement. The Service Provider shall only guarantee and do final details to the Makeup Application on those included in this agreement. The Service Provider may perform services on additional Attendants at her own discretion, at an additional cost, if time permits. The retainer is required to secure the booking of the date and Service Provider.

Within 7 (seven) days of the Effective Date as outlined in this agreement, the Client will pay the Service Provider a retainer of $100 + gst ($105) in order to secure the date with the makeup artist who will be the Service Provider for the Event Date. This retainer will be placed towards the Client's final balance of services provided on the Event Date. The retainer is non-refundable after 7 (seven) days of signing this agreement. Please be advised that dates, scheduled service times and artist/stylists time will only be reserved when a signed contract and retainer is received with a proof of payment Pre-payment of Travel Fees (if applicable) will be required at the time of the Retainer. The total will be provided to the Client in a detaile d email outlining the contract and deposit information.

COVID-19 is now a known risk factor when planning your event. Should an event not proceed due to COVID-19 restrictions, either specific to the event location or under local government mandates: (a) The retainer fee paid to secure the date and Service Provider(s) vill be transferrable one time only to a new date within 12 months of the original event date. An additional fee of $50 is required for re- scheduling. (b) If the makeup artist secured for the original date is not available for the new date the retainer remains non-refundable & the cancellation

(c) Should the Client postpone due to reasons not related to local government mandates, Cancellation guidelines will be in effect.

The remaining balance for all services provided by the Service Provider is due prior to the event or on the date of the event. If the Clients preference of payment is to be done prior to the event, this date can be arranged between the Client and Service Provider. Payment of services may be placed individually or as a group, and payment options available are cash or email transfer. Email transfers are to be sent to hjnlang@gmail.com

The Client identified in this agreement is responsible for the entire balance of payment should an Attendant fail to provide final payment for their services. Failure of the Client or Attendants to pay may result in the involvement of a debt collection agency to collect any owing to the Service Provider after a non-payment.

The Service Provider reserves the right to terminate this contract immediately for any breach of terms, and the contract will become void and all monies given are non-refundable. This booking arrangement cannot be changed after the Service Provider arrives for the appointment on the Event Date. If the Service Provider is required to cancel this agreement within 30 (thirty) days of the event for a reason other than breach of terms, but due to an unforeseeable circumstance or an unavoidable situation beyond the Service Providers control, the retainer and travel fee (if applicable) paid by the Client will be fully refunded within two weeks.

It is the responsibility of the Client to ensure that the cancellation notice of any amount of service is received through email and is acknowledged by the Service Provider. A cancellation form will be required to be completed and signed by both parties. Any changes to a confirmed wedding date or location is subject to availability of the Service Provider.

All travel fees for destinations located outside of the Calgary City will receive a custom quote by the Service Provider and will be paid for by the Client.

A hotel room will be required for the Service Provider for locations outside of Calgary that are further than 2 hours and/or require a start time earlier than 7:00am. This is to provide a safe amount of travel time for the Service Provider, as well as ensuring a prompt arrival by avoiding any unforeseen delays such as weather or traffic on the date of the event. Accommodations for the Service Provider will be booked by the Client at their convenience and they will notify the Service Provider with the proper location information. This accommodation must be booked prior to 30 days before the event date.

The Client shall not hold the Service Provider liable for any harm, claim, loss, costs, damage, injury or product reaction to any person or property arising, either directly or indirectly, from the Service Providers performance, or any other reason whatsoever. The Client agrees that a refund of 100% of the retainer and travel fee (if applicable) is the only liability to the service provider.

All tools and products used for services performed are kept sanitary and are cleaned between the Client and Attendants appointments. Any skin condition or allergies should be reported by the Client to the Service Provider prior to application and, if need be, a patch test of product may be performed on the skin to test for a reaction. The Client agree to release the Service Provider from liability for any skin complications due to allergic reactions. If the Client or Attendants have a serious skin/health conditions, the Service Provider will have to discontinue the service(s) due to hygiene complications.

Neither party shall be liable for damages, and have the right to terminate this Agreement for any delay beyond the reasonable control of the party claiming suspension of the agreement. These interrupted courses of events have not been caused by either parties' negligence, and the requesting party was unable to prevent through exercise of reasonable effort at a reasonable cost. This includes without limiting the generality of the foregoing, an act of God, war, terrorism, fire, lightening, severe weather, storms, floods, explosion, accident, shortage of labour or materials or government restraint, action, delay or inaction.

All disputes arising from this Agreement during the arrangement of services Or after completion as to any breach or alleged breach shall be decided by means of negotiation. If unresolved by a negotiation, the dispute(s will be referred to mediation.
